I was looking to purchase a house. I found a house on zillow.com, the listing agent was Gloria Marin of Virtual Properties Realty 178 S Main St #300 Alpharetta, GA 30009. After doing a walk through of the property with my own real estate agent I decided to put in an offer,and it was accepted. Gloria Marin requested that the $1000. earnest money be sent to her agency, Virtual Properties Realty. Earnest money is normally held by the buyers agency, but because Gloria Marin requested to hold my earnest money, my agent sent it to her. I paid $400. for an inspection, $100 for a re inspection and $500 for an appraisal including the earnest money that is a total of $2000. After getting the property inspected for the 2nd time I was waiting for Gloria to complete requested repairs. Then the house was unexpectedly vandalized, and every single appliance was stolen, the refrigerator, stove, microwave, dishwasher, furnace, and A/C condenser out side. After the vandalism Gloria claimed that after replacing all of the stolen appliances that she would no longer be able to afford to complete repairs on the property. (Also Gloria had been paid by the sellers of the house, to flip the property and sell it for them.) My closing date was quickly approaching, so my agent and I sent over a request for an extension for the closing date, because we were still waiting for Gloria to complete the repairs but she was still claiming that there is no money left to complete the repairs. Then without even responding to the closing extension, Gloria Marin just put the house back on the market and claimed that I was not entitled to my earnest money back, stating that I didn’t show up to the closing! I had to go to the Magistrate court to sue for my $1000. earnest money. At court I met with a mediator with the attorney for Virtual Properties Realty where they refused to give me back the whole $1000. I did not have a lawyer and I felt intimidated and that I had to settle for only $600. I have all of my court documents and email correspondence.
